This Site/ Application/ Services is/are operated /provided by Desh Recreation Private Limited operating under the brand name Tida Sports (“Us” or “Our” or “We” or “Tida Sports”). We operate and are engaged in organising sports and other recreational events as well as providing an internet-based booking platform for and in connection with Our as well as third party sports and other events such as sports fitness session(s), sports coaching/outdoor fitness sessions, sports related training activities and sports facilities and venues through Our Site, either by Our self or through Our subsidiaries, affiliates or third-party service providers (“Primary Services”). On our Site We provide a community-driven ‘Groups & Games’ feature, that allows Customers to connect with ‘groups’ and participate in sports games being organized near their locality (“Secondary Services”). These Terms of Use (“User Terms”) are a legal contract between you and Us.
Subject to the terms and conditions mentioned in these User Terms, you are hereby granted a non-exclusive, limited, non-transferable, non-sublicensable license, freely revocable license to use the Service for your personal, non-commercial use only and as permitted by the features of the Service. Tida Sports reserves all rights not expressly granted herein in the Service.
These User Terms apply to your visit to and use of the Site whether through a computer or a mobile phone or any other device, the Service, as well as to all information, recommendations and/or services provided to you on or through the Site and the Service.
By successfully registering your account with us, you are consenting to be bound by these User Terms. Please ensure that you read and understand all these User Terms before you use the Site. If you do not accept any of the User Terms, then please do not use the Site or avail any of the Services being provided therein. Your agreement to these User Terms shall operate as a binding agreement between you and Tida Sports in respect of the use and services of the Site.
Your acceptance of the User Terms shall be deemed to include your acceptance of the privacy policy available at our Privacy Policy Page.
By accepting these User Terms, you also allow Tida Sports to send you promotional emails and SMS alerts from time to time.
I. Definitions
All of the defined and capitalized terms in these User Terms will have the meaning assigned to them here below:
Account
Shall mean the account created by or for the Customer on the Site for availing the Services.
Applicable Law(s)
Shall mean and include all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority, tribunal, or a court of India.
Application
Shall mean the mobile application Tida Sports, owned and updated by Tida Sports from time to time.
Convenience Fee
Shall mean the fee payable by the Customer to Tida Sports for availing technology services offered by Tida Sports, chargeable on every Order made through the Site exclusive of applicable taxes.
Cancellation Fee
Shall mean the fee payable towards cancellation of an Order by a Customer in terms of Clause VII of these User Terms.
Customer / You
Means a person who has registered an Account.
Force Majeure Event
Shall mean any event arising due to any cause beyond the reasonable control of Tida Sports.
Tida Sports Pass
Means a pass or reservation allowing access to sports activities, fitness sessions, or venues on specified dates and times.
Order
Shall mean the order placed by a Customer to avail Services facilitated through the Site.
Order Value
Shall mean the total payable amount in Indian Rupees reflected on the Site for a specific Order.
Registration Data
Includes valid name, email ID, phone number and required registration info provided by the Customer.
Services
Shall mean a joint reference to Primary Services and Secondary Services.
Site
Refers to the mobile Application, website, and partner booking platforms owned or operated by Tida Sports.
Total Fee
Shall include Order Value, Convenience Fee, Cancellation Fee, Additional Fee, and taxes applicable.
Venue Membership Plan
Means a membership plan offered by venue partners purchased through the Site for recurring access.
II. Eligibility
You will be eligible to use the Services only if You are competent to enter into a binding contract under Applicable Laws.
If you reside in a jurisdiction that restricts the use of the Service because of age or restricts the ability to enter into contracts such as this User Terms due to age, Your use of Services shall bind Your legal guardian to these User Terms.
III. Registration and Account
- In order to access certain password-restricted areas of the Site and to use certain Services, you are required to successfully register an Account with Us.
- You shall ensure that the Registration Data provided by you is accurate, complete, current, valid and true and is updated from time to time. We shall bear no liability for false, incomplete, old or incorrect Registration Data.
- You are solely responsible for maintaining the confidentiality of your Registration Data and will be liable for all activities and transactions that occur through your Account. Your Account cannot be transferred, assigned or sold to a third party.
- We reserve the right to suspend or terminate your Account with immediate effect if we have reason to believe your Registration Data is incorrect or compromised.
- We allow only one Account in association with your Registration Data. In case of any unauthorized use, immediately contact us at info@tidasports.com.
- In case of Account blocking requests, We will not be liable for unauthorized transactions prior to the expiry of 72 hours after written notice.
IV. Services
You may order Our Services using Our Site. You will be charged the applicable fees set forth in the schedule of pricing, as prescribed from time to time.
By using the Site for availing the Service, you agree that you will only use the Service for personal use, will not try to harm the network, will comply with all Applicable Laws (including Information Technology Act, 2000), and keep your device safe and secure.
Marketing Communication (Call, SMS, Email, WhatsApp)
When you voluntarily submit your contact information, We reserve the rights to Call, SMS, Email or WhatsApp about our products and offers, even if your number has DND activated on it. You may opt out anytime by contacting us at info@tidasports.com.
V. Confirmation of Orders
Tida Sports shall, upon receiving the Order request, proceed to confirm or decline the Order based on ability to provide Service via SMS or email. You shall check Order details immediately and notify us of any errors.
VI. Payment
Tida Sports charges Total Fee for the Service. Payments can be made via Credit/Debit Card, Net Banking via authorized PCI-DSS compliant Payment Gateways, or Cash to venue owners where applicable.
Tida Sports also offers Split Payment Services allowing Co-Payers to share booking fees. All applicable taxes shall be borne and payable by the customer.
VII. Cancellation and Refund PolicyStrict Policy
TIDA Sports follows a strict no cancellation and no refund policy.
Once an order, booking, or registration is successfully completed on the TIDA Sports platform, it cannot be cancelled, modified, or refunded under any circumstances.
All payments made to TIDA Sports are:
- ❌ Non-refundable
- ❌ Non-transferable
- ❌ Non-exchangeable
- ❌ Non-adjustable
In case of any failed transaction where amount is deducted but booking is not confirmed, refund (if applicable) will be processed within 15 working days to the original payment method.
VIII. Customer Relationship Management & Grievance
All issues, complaints, opinions, suggestions, questions and feedback shall be communicated to our Grievance Redressal Officer, Mr. Sanchit Budhiraja through email address info@tidasports.com.
Reporting of any issue needs to be within 7 (seven) days of the occurrence. We endeavour to respond within 7 working days.
IX. Force Majeure
Tida Sports shall not be liable for any failure to perform obligations under these User Terms if performance is prevented, hindered or delayed by a Force Majeure Event beyond reasonable control.
X. Indemnification
You agree to defend, indemnify and hold harmless Tida Sports, its affiliates, licensors, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising out of your violation of User Terms, third-party rights, misuse of Services, or misrepresentation.
XI. Limitation of Liability
Services are provided on an "as is" and general information basis. Tida Sports disclaims liability for indirect, incidental, or consequential damages resulting from site usage, network issues, or vendor partner activities.
Tida Sports' total aggregate liability under any circumstances shall not exceed the Order Value paid for the specific order.
XII. Application License
Tida Sports grants you a limited, revocable, non-exclusive, non-transferable license to install and use the Application on a personal mobile device solely for personal, non-commercial use.
XIII. Content Posted and Shared
You retain ownership of content submitted by you, granting Tida Sports a worldwide, royalty-free license to host, display, and share Posted Content. Group messaging is end-to-end encrypted for privacy.
XIV. Intellectual Property Ownership
Tida Sports exclusively owns all rights, titles, logos, branding, graphics, visual interfaces, and code in relation to the Site and Services. All rights reserved.
XV. Links & Third-Party Services
Our Site may contain links to third-party services and Google Maps Geo-Location Services. We have no control over and assume no responsibility for third-party content or policies.
XVI. Term and Termination
This agreement remains effective until terminated. You may terminate at any time by deleting your Account. Tida Sports reserves the right to terminate access immediately in case of breach of User Terms.
